Hosting Agreement
Effective Date: February 9, 2026
This Hosting Agreement ("Agreement") is entered into between Faciotech ("Provider," "we," "us") and the client ("Client," "you") and governs the provision of web hosting and related services. By purchasing or using any hosting service from Faciotech, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement, along with our Terms of Service, Acceptable Use Policy, and Privacy Policy.
1. Scope of Services
Faciotech provides web hosting services including shared hosting, virtual private server (VPS) hosting, dedicated server hosting, domain registration and management, SSL certificate provisioning, website builder tools, email hosting, and related managed IT services. The specific features, resources, and limitations of each service are described on the relevant product page and in the order confirmation provided at the time of purchase. Pricing is available in both GHS (Ghanaian Cedi) and USD.
2. Account Setup
Upon successful payment and order verification, Faciotech will provision the Client's hosting account within 24 hours for shared and VPS hosting services. Dedicated server provisioning may take up to 72 hours depending on hardware availability and configuration requirements. Account credentials, including control panel login details, will be delivered to the Client's registered email address. The Client is responsible for maintaining the confidentiality of all account credentials and must notify Faciotech immediately if unauthorised access is suspected.
3. Resource Allocation
Each hosting plan includes specific allocations of disk space, bandwidth, CPU, memory, and other resources as described in the plan specifications. Shared hosting accounts operate on servers with multiple tenants; as such, resource usage must remain within fair-use guidelines to ensure equitable performance for all clients on the server. Faciotech reserves the right to suspend or throttle accounts that consistently consume disproportionate resources, after providing reasonable notice and an opportunity to upgrade to a higher-tier plan.
4. Server Management
For shared hosting, Faciotech manages all server-level operations including operating system updates, security patching, firewall configuration, and service monitoring. For VPS hosting, Faciotech provides the underlying hypervisor infrastructure and network connectivity; the Client is responsible for the operating system and software within the VPS unless a managed VPS plan has been purchased. Dedicated server clients receive full root access and are responsible for all server administration unless a managed service agreement is in place.
5. Content Restrictions
The Client is solely responsible for all content hosted on their account. The following types of content are strictly prohibited:
- Content that infringes intellectual property rights, including copyright, trademark, or patent
- Malware, phishing pages, or any software designed to damage or gain unauthorised access to systems
- Content that is unlawful under the laws of Ghana or the jurisdiction in which the Client resides
- Unsolicited bulk email (spam) distribution infrastructure or open mail relays
- Cryptocurrency mining software or processes
- Proxy or anonymisation services that facilitate illegal activity
- Content depicting child exploitation or abuse in any form
Faciotech reserves the right to remove prohibited content and suspend or terminate accounts in violation, with or without prior notice depending on the severity of the violation.
6. Bandwidth and Storage
Bandwidth and storage allocations are specified in the Client's chosen hosting plan. "Unlimited" bandwidth or storage, where offered, is subject to our fair-use policy and is intended for normal website operation. Activities that consume bandwidth or storage far beyond what is typical for a hosting account of the same tier, such as file distribution, video streaming from the server, or serving as a backup repository, may result in a request to reduce usage or upgrade the plan.
7. cPanel and Control Panel Access
Shared and VPS hosting plans include access to the cPanel control panel (or equivalent) for managing websites, databases, email accounts, DNS records, and other hosting functions. The Client agrees to use the control panel responsibly and not to attempt to circumvent resource limits, modify server configurations beyond the scope of their access level, or exploit vulnerabilities in the control panel software.
8. Email Services
Hosting plans include email hosting with the Client's domain. Email accounts are subject to sending limits designed to prevent abuse and maintain the reputation of our mail servers. Mass email campaigns, newsletters, or transactional emails at high volume must be sent through a dedicated email marketing service rather than the hosting account's email system. Faciotech may temporarily restrict email sending if suspicious activity is detected, and will notify the Client promptly.
9. SSL Certificates
Faciotech provides free Let's Encrypt SSL certificates with all hosting plans. Premium SSL certificates (such as EV or Wildcard certificates) are available for separate purchase. SSL certificates obtained through Faciotech are subject to the issuing certificate authority's terms and conditions. It is the Client's responsibility to ensure SSL certificates are renewed before expiry; Faciotech enables automatic renewal for Let's Encrypt certificates but cannot guarantee renewal if DNS or domain ownership verification fails.
10. Backups
Faciotech performs periodic server-level backups as a courtesy measure for disaster recovery purposes. However, the Client is solely responsible for maintaining their own independent backups of all website files, databases, email, and other data. Faciotech does not guarantee the availability, completeness, or integrity of any backup and shall not be liable for data loss. Clients are strongly encouraged to use the backup tools available in cPanel or to implement their own automated backup solution to a remote location.
11. Software and Scripts
The Client may install and run software and scripts that are compatible with the hosting environment, provided they do not violate our Acceptable Use Policy, consume excessive resources, or create security vulnerabilities. Faciotech does not provide support for third-party software, plugins, or custom scripts. The Client is responsible for keeping all software, content management systems, and plugins up to date with the latest security patches.
12. Server Abuse
Any activity that degrades server performance, compromises security, or adversely affects other clients constitutes server abuse. This includes but is not limited to running background processes that consume excessive CPU or memory, sending unsolicited email, hosting malware or phishing sites, participating in or facilitating DDoS attacks, and attempting to gain unauthorised access to other accounts or systems. Faciotech monitors server activity and will take appropriate action, including immediate suspension, upon detection of abuse.
13. Account Suspension
Faciotech may suspend a Client's account under the following circumstances:
- Non-payment of invoices beyond the grace period specified in the invoice terms
- Violation of the Acceptable Use Policy or content restrictions outlined in this Agreement
- Server abuse as described above
- Receipt of a valid legal or regulatory order requiring suspension
- Security compromise of the Client's account that poses a risk to other clients or infrastructure
Faciotech will make reasonable efforts to notify the Client before or immediately after suspension, except where immediate action is required to protect infrastructure or comply with legal obligations. Suspended accounts may be reactivated upon resolution of the underlying issue and payment of any outstanding balance plus a reactivation fee, if applicable.
14. Termination
Either party may terminate this Agreement at any time. The Client may cancel their hosting service by submitting a cancellation request through the client portal or by contacting support. Upon cancellation, the Client's data will be retained for 30 days to allow for retrieval, after which it will be permanently deleted. Faciotech may terminate this Agreement immediately if the Client materially breaches any of its terms and fails to remedy the breach within 7 days of written notice. Refunds upon termination are governed by our Refund Policy.
15. Migration Assistance
Faciotech offers free website migration assistance for new clients transferring their hosting from another provider, subject to the following conditions: migration requests must be submitted within 30 days of account activation; the source hosting account must be accessible via cPanel or FTP; and the total data to be migrated must not exceed the storage allocation of the Client's chosen plan. Complex migrations involving custom server configurations, multiple databases, or specialised software may incur additional charges, which will be communicated before work begins.
16. Third-Party Software
Faciotech may integrate with or provide access to third-party software, tools, or services. These include but are not limited to Softaculous (application installer), WHMCS (billing platform), and various CMS applications. Use of third-party software is governed by the respective vendor's terms and conditions. Faciotech is not responsible for the functionality, security, or availability of third-party software and disclaims all liability for losses arising from the use of or reliance upon such software.
